PIL Filed in Court to CANCEL SBI Clerk 2016 Recruitment
No other news could be more shocking than the possibility of SBI clerk recruitment 2016 getting cancelled.A bank job aspirant has filed a case in madras high court against state bank of India for not allowing loan defaulters to apply for their recruitment of 17,000 junior associate (clerical) jobs.He has also sought the court to direct SBI to issue a fresh notification for all candidates to apply.
The SBI clerk recruitment for 17000 junior associates & junior agricultural associates was announced in March 2016.It is the largest hiring by a public sector bank in recent years.
In addition to the regular eligibility conditions for age & educational qualifications, there was one specific rule regarding loan repayment. The validity of it is now being questioned.
What is the Case About?
S Gurukrishna Gokul, an aspirant has filed a public interest litigation (PIL) on May 25 in the Madras high court against State Bank of India.
In his petition, he has stated that SBI in its recent clerical notification, had declared candidates with record of default in repayment of loans as not eligible for these jobs.
“This condition will prevent a large number of economically & socially backward candidates from applying for the posts. If they were appointed, after selection process, they would be able repay the loans”, he insisted.
He has also submitted that, instead of providing employment for candidates to make them repay loans, the bank is creating more educational loan defaulters by coming up with such “unreasonable & arbitrary ineligibility conditions”.
Many are Affected; So Quash the Recruitment
Adding to the petition, he claims that at a time when a large number of poor students were searching for jobs in government & public sector units, this condition made them ineligible to apply for the exam.
He has requested the court to direct State bank of India to cancel the clerk recruitment & issue a fresh notification so that more candidates can apply.
Notice sent to SBI & Indian Govt: The Madras High Court bench comprising of Justices R Mahadevan & SS Sundar have issued notices to the SBI chairman & central government.
As per the order, they are required to file their explanation on this PIL within 2 weeks.
What Next: Will SBI Recruitment be Cancelled?
Since the court has given two weeks time to explain their stand, what the union govt & SBI have to say on this PIL is yet to be seen
Whatever it is, their defense should be strong enough to convince the bench because the petition is about employment of lakhs of students.
If you are wondering what could happen next, here are the possible outcomes:
1) If the bench finds fault with SBI, they may strike down the recruitment & order the bank to issue a new notification as sought by the petitioner.
OR
State bank may agree to open the application process again for candidates who were ineligible earlier due to loan default, to register again.
2) If SBI manages to convince the court by explaining the reasons behind such a rule, then the recruitment WILL NOT be cancelled.
But, State bank of india might continue with this condition for their future recruitments as well.
Hence the final verdict of this PIL case will have a far reaching impact especially on those students who are completing their degree through loans & aspiring for bank jobs.
Delay in Clerk Exam Results?
The sbi clerical exams are currently underway all over India.Since the tests are conducted online, results are normally announced within 7 –10 days after completion.
With a case already in court, there is a question on whether SBI will release the 2016 clerk exam results on time or wait till the proceedings are over.
Incase they choose to wait for the judgment, announcement of results could get delayed.
Is SBI Clerk 2016 Prelims Exam cancelled?
